๐Ÿ“˜ 1. Introduction

Lizboyle (โ€œwe,โ€ โ€œour,โ€ or โ€œusโ€) respects the intellectual property rights of creators, brands, artists, designers, copyright holders, and trademark owners. We are committed to complying with all applicable copyright, trademark, and intellectual property laws.

This Intellectual Property Claim Policy explains how rights holders can report suspected misuse of their intellectual property on our website or through our services. The purpose of this policy is to promote transparency, protect legitimate rights holders, and ensure compliance with Shopify and Google Merchant Center standards.

This policy applies to copyright claims, trademark claims, counterfeit product claims, misuse of proprietary or original designs, and other intellectual property concerns. DMCA takedown requests are handled separately under our DMCA Policy.

โš ๏ธ 2. What Qualifies as an Intellectual Property Violation

You may submit an intellectual property claim if you believe your protected rights have been copied, reproduced, displayed, sold, or used without proper authorization, or misrepresented in a way that infringes your legal rights.

Examples of potential violations include copyright infringement such as unauthorized use of images, graphics, artwork, written content, or original product designs. Trademark violations may include unauthorized use of brand names, logos, confusingly similar marks, or counterfeit products bearing your trademark. Other violations may involve the unauthorized sale of proprietary products, imitation of custom or protected designs, misuse of packaging, or use of protected digital content.

If you are unsure whether your concern qualifies as an intellectual property violation, you may still contact us to discuss the matter.

โœ‰๏ธ 3. How to Submit an Intellectual Property Claim

To submit an Intellectual Property Claim, please email support@lizboyle.com with the subject line โ€œIntellectual Property Claim โ€“ [Your Name or Company]โ€.

Your submission must include complete and accurate information so we can properly evaluate your request.

๐Ÿ” Required Information

You must provide your full legal name, company name if applicable, mailing address, phone number, and email address. You must also clearly identify the intellectual property being claimed by providing relevant registration numbers, proof of ownership, original files, portfolio links, timestamps, or other verification materials.

Please include a clear description of the allegedly infringing content, the exact URL or URLs on our website, and an explanation of how the content infringes your rights. Screenshots or visual examples are helpful but not required.

โœ๏ธ Formal Declaration

Your claim must include statements confirming that you have a good-faith belief the use is not authorized, that the information provided is accurate, and that you are the intellectual property owner or authorized to act on the ownerโ€™s behalf. You must also acknowledge that submitting false or misleading claims may result in legal consequences. A physical or electronic signature (typed full legal name) is required.

Incomplete claims may be delayed or rejected until all required information is received.

๐Ÿ”Ž 4. What Happens After a Claim Is Submitted

Once we receive a complete intellectual property claim, we will review it within 3โ€“5 business days. During the review process, we may temporarily remove or restrict access to the content in question. We may contact you for additional information or clarification if needed.

We will notify the seller or content uploader of the claim and, where appropriate, permanently remove the infringing material. Each claim is reviewed individually and handled in good faith.

๐Ÿ”„ 5. Counter-Notification Process

If content is removed as a result of an intellectual property claim, the affected party may submit a counter-notification if they believe the claim is incorrect or that they have proper authorization.

A valid counter-notification must include the individualโ€™s full legal name and contact information, identification of the removed content, a statement explaining why the removal was made in error, evidence of ownership or authorization, consent to U.S. jurisdiction for legal disputes, and a physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original claimant and allow 10โ€“14 business days for legal action to be initiated. If we do not receive notice of a court order within this period, the content may be restored.

๐Ÿšซ 6. Repeat Infringer Policy

To protect intellectual property rights and maintain platform integrity, Lizboyle may take action against repeat infringers. This may include removing or disabling content, restricting account privileges, blocking product listings, terminating access to our services, or preventing further uploads. Determination of repeat infringement is made at our discretion.

โ— 7. False Claims & Abuse of Reporting

Submitting false, misleading, or fraudulent intellectual property claims violates this policy. Such behavior may result in account suspension, permanent bans, reporting to legal authorities, and potential civil liability. We encourage all claimants to verify ownership and authority before submitting a claim.

โš–๏ธ 8. No Legal Advice

This Intellectual Property Claim Policy is provided for informational purposes only and does not constitute legal advice. If you are unsure whether your rights have been violated or how to proceed, we recommend consulting a qualified intellectual property attorney.
